By using our services, users expressly accept these terms.
1) Service Purpose
- Kluk is an application that generates custom clothing designs from users’ voice notes and references.
- If the user wishes to order a garment, they may share body measurements and/or photos with the seamstress in a private chat solely for custom tailoring.
- Physical product shipments are handled via DHL and Correos.
2) Credit System (no subscriptions)
- No monthly or annual subscriptions.
- Credits: 1 credit = €1.
- Welcome bonus: €20 in credits for new users.
- Redemption:
- Designs: €0.10 per design.
- Garments: price set by the seamstress based on type and materials.
- Shipping: free on all orders.
- Product returns: within 20 consecutive days from receipt.
Updated Credit Packs (as per your image):
- €20 pack → 20 credits + 2 free credits
- €50 pack → 50 credits + 10 free credits
- €100 pack → 100 credits + 25 free credits
- €150 pack → 150 credits + 45 free credits
- €200 pack → 200 credits + 70 free credits
- €250 pack → 250 credits + 100 free credits
3) Production and Shipping Times
- Production time: communicated by the seamstress via chat, depending on complexity and materials.
- Shipping times:
- Spain: under 7 business days.
- Rest of Europe: 3–15 business days depending on the country.
- Carriers: DHL and Correos.
- Tracking: reasonable tracking information will be provided when available.
4) Payments and Security
- Accepted payment methods: Apple Pay and Google Play.
- Kluk does not directly store or process users’ banking or sensitive financial data; these are handled by the payment platforms.
- Prices may vary by country due to local taxes, fees, exchange rates, or regional charges.
5) Personal Data We Process
- Registration and contact data: email, postal address, and phone number (for shipping and in‑app segmentation only).
- Tailoring content: voice notes, body measurements, and photos voluntarily shared in the private chat with the seamstress, exclusively for design and tailoring.
- Usage data: in-app interactions, design history, preferences, language, and basic technical data to improve the service.
- We do not share data with third parties for advertising or commercial purposes. Processing is limited to Kluk’s operations and necessary processors (e.g., hosting, messaging, logistics, and payment gateways).
6) Purposes of Processing
- Service delivery: design generation, order management, tailoring, and customer support.
- Logistics: preparation, shipping, and returns (via DHL and Correos).
- Communication: order status, production times, support, and account security.
- Internal segmentation: personalization within the app (no third‑party transfers).
- Legal compliance and fraud prevention.
7) Legal Bases
- Contract performance: service provision, order management, chat with seamstress, and shipping.
- Legitimate interest: service improvement, security, and fraud prevention.
- Consent: processing of voice notes, photos, and measurements for tailoring; optional marketing communications if enabled.
- Legal obligations: tax, accounting, and consumer regulations.
8) Data Retention
- Account and contact data: while the account is active and for the time required by law.
- Design content, voice notes, measurements, and photos: retained for the time needed for design/tailoring and statutory warranty/claims periods. Users may request deletion unless legal retention applies.
- Transaction records: kept per applicable tax and commercial retention periods.
9) Recipients and Processors
- Technology providers: hosting, basic internal analytics, in‑app messaging, notifications, and secure storage.
- Payment processors: Apple Pay, Google Play.
- Logistics: DHL and Correos (access only to data needed for shipping).
- No sale or transfer of data to third parties for advertising.
10) International Transfers
- If we use providers outside the EEA, we will apply appropriate safeguards (e.g., Standard Contractual Clauses) and additional security measures where applicable.
11) Users’ Rights (GDPR/LOPDGDD)
- Access, rectification, erasure, restriction, portability, and objection.
- Withdraw consent at any time for consent‑based processing (e.g., retaining photos/measurements for future tailoring).

- Right to lodge a complaint with the AEPD or relevant supervisory authority.
12) Security
- We apply technical and organizational measures appropriate to risk: encryption in transit, access controls, activity logs, and data minimization.
- The chat with the seamstress is private within the platform; avoid sharing unnecessary data. Kluk does not request health data beyond essential measurements for tailoring.
13) Intellectual Property and Content Use
- Designs generated in the app are intended for the user’s personal use within Kluk’s ecosystem.
- Kluk retains rights over the platform and tools. Users do not acquire IP rights over the software or underlying AI components.
- Users warrant that references or content they provide do not infringe third‑party rights. Kluk may remove unlawful or inappropriate content.
14) Returns and Refunds
- Digital designs: non‑refundable once generated due to their digital and personalized nature (€0.10 per design).
- Physical garments:
- Free returns within 20 calendar days from receipt.
- Garments must be in appropriate condition, except in case of defect.
- Refunds in credits or replacement, at the user’s choice and subject to availability.
- Shipping: always free.
- Credits are not refunded due to non‑use unless required by law. If an order is canceled before production starts, the corresponding credits will be refunded.
15) Credit Management
- Purchase of packs as listed above; credits are added to the user’s balance.
- Welcome bonus: €20 in credits on sign‑up (may be subject to anti‑fraud conditions).
- Usage and balance: credits are spent when generating designs or confirming garment orders; balance is shown in‑app.
- Fraud or abuse: Kluk may suspend or reverse credits obtained improperly.
16) User Conduct
- Do not share illegal, offensive, or infringing content.
- Do not use the app for purposes other than custom clothing design and tailoring.
- Kluk may suspend accounts for serious or repeated violations.
17) Limitation of Liability
- Kluk does not guarantee results identical to user references; designs are interpreted from voice notes and available materials.
- Shipping times may vary due to logistics or customs beyond our control.
- To the extent permitted by law, Kluk is not liable for indirect damages, lost profits, or data loss arising from use of the service.
18) Minors
- The service is intended for users aged 16+ (or the local equivalent minimum age). If underage, use the service only with verifiable parental/guardian consent.
19) Changes to this Policy
- We may update these terms and the privacy policy to reflect legal or functional changes. We will notify users in‑app or by email for material changes. Continued use after notice implies acceptance.
20) Governing Law and Jurisdiction
- This policy is governed by current Spanish law.
- Any disputes shall be subject to the courts corresponding to the legal representative’s domicile, without prejudice to mandatory consumer jurisdiction.
